В настоящей работе исследован институт комплексного развития территорий, определены его ключевые признаки, выявлены способы защиты прав заинтересованных лиц при реализации КРТ, проанализирована релевантная судебная практика. Отдельная часть работы посвящена установлению основных недостатков КРТ, в том числе с точки зрения соблюдения баланса частных и публичных интересов. В результате работы предлагаются способы решения выявленных проблем, направленные на защиту прав правообладателей, попавших под реализацию КРТ.

In this paper, the institute of integrated territorial development is investigated, its key features are identified, ways to protect the rights of stakeholders in the implementation of the CRT are identified, relevant judicial practice is analyzed. A separate part of the work is devoted to identifying the main drawbacks of MAPS, including from the point of view of maintaining a balance of private and public interests. As a result, the work suggests ways to solve the identified problems aimed at protecting the rights of copyright holders who have fallen under the implementation of the CRT.
